Working From Home? It Could Affect More Than Your Tax Deductions

Many business owners don't realise the tax implications may extend well beyond their annual tax return.

If you run a business from home, whether that's a family day care, consulting practice or home-based service business, there is a common misconception that could have significant tax implications down the track.

Many people assume that as long as they don't claim deductions relating to their home, they won't face capital gains tax consequences when they eventually sell the property.

Unfortunately, the rules are not quite that simple.

The main residence exemption can be affected where part of a home is used as a genuine place of business. Importantly, the tax outcome is not determined solely by what deductions you claim, but by how the property is actually used.

What matters is the character of the space itself. If part of your home has been set aside as a dedicated place of business, the capital gains tax consequences may arise regardless of whether you have claimed occupancy expenses along the way.

Simply choosing not to claim deductions does not necessarily eliminate the issue. It may simply mean you've missed out on legitimate deductions while still facing the same tax outcome in the future.

Why Planning Matters

While strategies may be available, they are rarely automatic.

Future tax outcomes can be influenced by factors such as business structures, asset values, retirement plans, property ownership and timing. Events such as retirement, aged care decisions, illness or changes in family circumstances can arrive unexpectedly and affect the options available.

That is why these conversations are most effective well before a contract of sale is signed.

Working from home remains a valuable and practical option for many business owners. The key is understanding the broader implications and making informed decisions based on your individual circumstances.

Think Beyond Today's Tax Outcome

When the draft legislation for the trust minimum tax was released, it came with a reassurance: if you do not want to restructure, you can simply make an election instead — no restructure, and no state stamp duty. That is accurate, but it is also a very small part of the decision. Here is why you should choose your structure for the eventual sale of your business, not for the announcement.
